couldnt they have also used the 8.25. IIRC the brakes are exactly the same.

Not in my experience. I swapped one off of my old c-clip D35 straight to my 29 spline 8.25 with zero modification. And used the 29 spline brake hardware. Maybe the non c-clip version is different

I thought it was d35 and d44 could use the same hardware because they are both dana axles? hmm

i thought the D44 used the larger drums and shoes. 10" vs 9"

D44 did indeed use 10" drums however so did some early D35 XJs. I have not verified whether they used the same backing plate but my gut says now as the brakes are different, 10" x 2" vs 10" x 2.25" from what I recall.
