A Federal judge in San Diego recently ruled that the Boy Scouts' use of public land owned by the City of San Diego was unconstitutional because the scouts are inherently a "religious organization." We don't now what the judge defines as a religious organization, but if he's talking about the scouts' belief in "God and Country", that must be the problem. However, we can think of no other civic youth organization (other than the Girl Scouts) that does a better job of instilling in our youth the values of good citizenship and in using our public lands responsibly.
Fortunately, the Boy Scouts are going to appeal this decision. Unfortunately, they are going to spend a lot of money in legal fees that could be going towards other worthy scouting programs. We are going to continue to follow this story closely. If clearer heads don't prevail, who knows, maybe scouts will no longer be permitted on Federal public lands as well. That would be the ultimate anti-access victory--something none of us should be prepared to accept.
