DUI Laws have no bearing here. Yes he was most likely drunk but days after the fact it would be difficult if not impossaible to prove. They charged him with what they could prove. Unfortunately that is the way our "laws" work.

agreed, been there. im just now starting to feel injuries from a motorcycle wreck i had in 2002.

Funny, the drunk driver is from my Uncle's town.
