As long as your upright support for the tire carrier isn't going to interfear with opening the tailgate?
A couple of things that I prefer about a side opening tire carrier is that:
1. You don't have to lift the entire weight of the wheel/tire up to position
2. You don't have as much in between you and the cargo area when trying to load things.
Make sure everything is tight tolerances, or it will rattle! Maybe put some rubber bumpers in the design so there is some counter pressure put on it, and a good pivot solution.
Edit: read your original post. Definitally put in a stopper so it doesn't open too far. Maybe some hatch shocks to control the movement.
