Quick question on Baja Lights

i put on a set of baja lights...they say that they are considered driving lights if they are mounted in a certain height and fog lights if they are lower....mine are at the same height as my normal headlights....am i allowed to drive around with my new lights and my regulaer headlights on or is that illegal...any info would be great!!!!
