60-0 braking?

i'm going to aregue a ticket tomorow so speedy reply would be greatly appreciated. i drove through a yellow light and i got a ticket. the officer said i had enough time to brake, then tried tellin me it was red. he said i was fifty feet away from the intersection when it turned yellow. i was doin 40mph and it was rainy.
so i looking for the 60 - 0 braking for the cherokee. just trying to get a lil more ammo for my arguement. thanks
 
40-0 in 50 feet on wet roads? not a chance. I'd probably stop on the other side of the interesection (siped AT tires, no ABS, no lift)
 
that's what i said. i asked the officer if i woulda locked up my brakes and stopped in the middle of the intersection if he woulda still givin me a ticket. he just laughed and continued with " you had enough time blah blah..
 
You probably prevented the oinker from making a left on his way to the doughnut shop:)
What year cherokee? If you are planning on fighting it better get some documented measurements and plenty of pictures of the light and intersection, maybe a weather report from the date said. good luck
 
yeah. i was planning on gettin a weather report. and i have been searching the internet for the stock braking distances. i having some trouble though. so if anyone knows where to find such things please let me know.
 
Just challenge what the officer has already told you! If he can't back it up he has no case.

1. "the officer said i had enough time to brake"

How can he know this without knowing how fast you were going (radar gun) and the condition of you brakes and tires?? (also don't say how fast you were going unless asked)

2. "he said i was fifty feet away from the intersection when it turned yellow"

Did he get out in the rain and measure the road? If he didn't he can't say it was fifty feet or any distance for that matter. Anyway it makes NO SENSE AT ALL that you could stop. Let me explain why:

40 miles per hour is 58.67 FEET PER SECOND

How can anyvehicle come to a complete stop in less than 1 second from 40 mph? (if the claimed distance is 50 feet)

Another thing to consider is that average human reaction time to brake is 1 second. (at least thats what I've heard) This includes the time it takes to lift your foot off the gas and apply the brake.

So one second after the light turned yellow you would already be 8.67 feet into the intersection BEFORE braking started.

So there is no way you could have stopped.


My point is that the cop isn't taking into account your reaction time and the distance traveled in that time. Braking isn't instantaneously started as soon as a light turns yellow!

I hope the judge throws this out for you.

Noobs! (to court, that is...)

Take it from an old timer who has tried many, many, many times to fight tickets. This is not going to work. But I know what will...

Here's what would happen if you tried to bring in pictures of the intersection and spout of facts a figures:

The judge (and prosecuting attorney) will question your qualifications for knowing such facts as stopping distance, reaction time, and distance traveled per second. Trust me - you’d be better off pounding your head with a tire-iron.
The officer will "forget" facts like how far you were away from the intersection, how fast you were going, etc. etc. and just say that it was his opinion that you could of have stopped.
That is GOLD to the judge. It's all he has to hear. The judge will say that the officer is a trained professional and knows what he's doing.
You will be called a liar - because of course, you have no credibility, and will be sent packing with a bill to pay and points against your license.

The ONLY way to fight this is with an attorney - PLEASE, PLEASE trust me. It doesn't go well for 99% of people who try to fight tickets.
If the judge knows there's a defense attorney, quite often the ticket will be just thrown out - very few, or no questions asked.
If they want to fight it, the attorney should hire an accident reconstruction specialist. The court will recognize that they are QUALIFIED to spout off facts and figures like how many feet per second you are traveling at any given speed. How rain affects stopping speed, etc.
The court WILL NOT accept anything you have to say as qualified information.

I think I'm more than qualified to provide basic kinematic facts.

If they question my knowledge of this material I'll bring them one of my professors who gave me an A+ in engineering dynamics.

But I don't plan on getting a ticket if I can help it.
 
In California there is a minimum time the yellow light MUST be on before the red. If I recall a bunch of "red light camera" tickets were thrown out because of short timed yellow lights.
Get out your stop watch and check the CO. law for timing.

But . . .

The cops tend to win even if you 'know' you are right.
I know.
Cost me $200+ for the ticket + $1000- more over 3 years for insurance. Traffic school can be your friend against a cop that may 'forget' some facts.
 
thanks to all. i tried a few of your excellent decisions. but in the end, it was his word against mine. so i lost. oh yeah, and the ass lied. oh well, $119 down the drain.

here's a tip: don't go through yellow lights, they may look yellow but i guess i'm color blind
 
Were you through the intersection before it turned red? I believe that's legal to do....

Although once my mom got pulled over and was given a warning. The light turned yellow and she was already in in the intersection. I know a warning is nothing, but what was there to warn about? I still don't get it.....that was like 12 years ago though.

quite possibly he was,but without video it ended up being his word vs a police officers, police wins everytime.

I don't know how it is in NE but in NY all the cops have dashcams that convieniently don't work for court.

You should have just paid it. First if you say it was wet and you didnt have enough time to stop then you are traveling to fast for the road conditions ( doesnt matter what the posted speed is). Two a yellow light means stop and going through them is the same as going through a red. Should have just owned up to it and payed your ticket, now they will tac on court fines.
