We may lose winter access and have limits on how many rigs can travel down the trail (or even WORSE) if we do not win this one.
The Rubicon Trail Foundation needs as many signed affidavits as possible before the 31st of this month. Lance has prepared this link with instructions on what to do:

Two questions...
1. What is the legal strategy by this affidavit? Are we trying to say closing the trail will not reduce traffic in the foothill area, becuase we will just move somewhere else?
2. Item 6 in the affidavit says something about wheeling in an adjacent county or trail anytime the Rubicon is closed. It seems to say that if the Rubicon is closed, we will go wheeling during the closure somewhere else, even if we didn't have plans to use the 'Con during that closure. Am I understanding that correctly?

First off, I'd like to thank Cal for his generous support and assistance of adding a dedicated fax/email converter -- this is a huge assist for us at Rubicon Trail Foundation (RTF)! Apparently, a similar thread was posted on a JK forum and removed because it linked to a 'competitor' -- kudos for the XJ guys for seeing that land access is no issue for 'competition!'

We're not lobbying with simple email this time around, rather, we are clearly illustrating an impact of displacing recreation. Our intent is to remind the Regional Water Quality Board that if they believe water quality is at risk on Rubicon (we disagree), that same risk exists from displaced usage, and that the California Environemntal Quality Act (CEQA) requires them not to create 'significant impacts' without a detailed planning process. 1500-plus users displaced to other resources is unequestionably a 'significant impact' on other resources!
Item 6 in the affidavit says something about wheeling in an adjacent county or trail anytime the Rubicon is closed. It seems to say that if the Rubicon is closed, we will go wheeling during the closure somewhere else, even if we didn't have plans to use the 'Con during that closure.
What we're pointing out is that if Rubicon is closed, significant usage will be displaced to other local resources (and it isn't critical for us to individually identify WHICH resources -- it is enough to remind that usage will be generally displaced) -- that's not a threat to 'wheel illegally, rather, it is a realistic reminder that this demand exists and will continue to do so even if Rubicon is closed, and we'll have to find other places to recreate legally. The Central Valley Regional Water Quality Board is responsible for a huge watershed -- it does them little good to displace users from one place to another within it... and CEQA frankly prevents it.
We are also showing how many users are willing to quickly mobilize to support Rubicon -- this is not a vote, but at the same time, we don't want to lose the vote... the closurists flooded the Water Quality Board with useless form letters ( http://salsa.democracyinaction.org/o/2167/t/5243/campaign.jsp?campaign_KEY=26793 ), irritating them... we're taking a different tack and queuing legal testimony (affidavits) internally, and will be submitting them respectfully as large chunks, so that we don't flood the Water Quality Board's office. It underlines the difference between OHV and the closurist -- we're willing to work with the Water Board as respected partners, and the closurists would rather shrilly scream and lambaste from a distance, without cooperation or respect.
BTW, you efforts are paying off -- we've passed 1500 faxes in a few short days, and this will make an impressive !THUD! when we plunk 'em down on the table at the Water Board Hearing! :paperwork:

Thanks for the effort -- this fax campaign runs through the end of the month, so there's still plenty of time to get the word out to more Rubicon users, or potential Rubicon users!
