View Full Version : Legal advice needed QUICK....Rental Agency

My Fiance and I were going to be moving into a new rental house in the next few days. We went to a rental agency, they approved us for the place but the lady didn't have time for us to sign the contract or anything for the lease and what not. Well, my Fiance went in the day after and paid the first month and deposit to get it out of the way. Her mom calls her literally 3 hours after and tells her she just found out she has cancerhttp://www.dezertrangers.com/vb/images/smilies/eek.gif. So obviously my Fiance wants to go to So Cal to be with her mom and calls the rental agency to tell them she is going to be moving to So Cal for a while and can't move in. They tell her they wont give her the deposit money back($900). Can they do this? We haven't signed ANYTHING yet.

You haven't signed anything,neither has the rental co. Was it a check?

Ok well I just talked to my buddys sister who is a lawyer and she sais we have 72 hours to refuse the movie in wether we signed anything or not and they HAVE to give us our money back.

My fiance typed them up a letter that gave our refusal so I went down there and talked to the lady. She was still trying to say that we can't get our deposit back but I simply told her that if the money is not refunded by monday she will have papers served on tuesday(in a nice way). She then proceeded to say that it will probably be no problem but she will have to wait till monday. It just REALLY pisses me off, my fiance just found out her mom is most likely going to die from cervical cancer and the lady is a total BITCH!

If there's no contract, then she can't make you do sh!t, but it could be pretty difficult for you to get your money back if she puts up a fight.

small claims court and 150.00 should solve your issues quickly if all else fails. good luck to you and yours.
