The seven-foot-tall memorial cross, erected in 1934 by World War I veterans as a war memorial to honor all fallen soldiers, stands in the midst of the 1.6 million-acre Mojave Preserve. The legal case arose when a former National Park Service (NPS) employee living in Oregon sued for the memorial's removal. Following attempts by Congress to designate the memorial as a national memorial and to transfer the land to the VFW, the District Court and Ninth Circuit Court both ruled that the memorial is unconstitutional and must be removed. The court also ordered the memorial covered with a plywood box until the U.S. Supreme Court ruling.

It appears this football has been kicked around for awhile now.

My bet is that many would like to know the name of the former NPS employee who started this little charade.

Oregon has this go on all the time. There is this group called 'Friends of Oregon', it is anything but. They are not from Oregon but they tell us they know better than us how we should live.
The federal government has caught the Forrest Service changing evidence on on court cases and will not fire them just transfer them. This coming from a NPS here doesn't surprise me at all.

Bringing it back for an update:
The Supreme Court has ruled in favor of keeping the memorial, 5-4. CLose decision, but at least they made the right one!

Yeah, and I have a pretty good idea why.

Read an article that put forward the position that the ACLU suit was moot after the cross was stolen, and that would allow the Park Service to go ahead with the land swap that would give that rock to the VFW. So, in a panic, the losers put the cross back up to keep the law suit alive--and how in the hell are they getting in and out of there, working at night, and not being caught? A little Park Service assistance--remember, it was a Park Service employee POS that filed the suit to start with.
